EU whistleblowing provisions need adjustments in member states

Seven months remains for EU member states to transpose the whistleblower directive into national legislation. The directive as such only offers protection when reporting about breaches of EU law in specific sectors. However, for an individual whistleblower to determine what is a breach of EU law and not national law is a difficult call to make. Member states still have an opportunity to fix this confusion. The directive sets out minimum standards and there is nothing that prevents member states to go further.

Here are a few suggestions to fix on national level:

1. Widen the material scope

The directive might come across as confusing, as it lists different material scopes of legislation that are covered by the directive.[1] What it does not cover are for example working conditions, non-discrimination, occupational health and safety. For individual workers it is a thin line to decide whether to blow the whistle on wrongdoings or not. Nobody wants to take the risk of falling outside the scope of protection. The simplest was forward is to include national legislation, and stretch the scope to include all areas horizontally – not only those listed in the directive. For example bad working conditions or lack of resources in the health care sector can easily lead to wrongdoings. How can an individual determine whether this falls within the scope of working conditions (not covered by the directive) or under public health (covered by the directive)? To avoid any pitfalls and to offer legal protection, we cannot have these kind of uncertainties.

2. Secure trade union rights

It is not self-evident that trade union rights are guaranteed in this directive. Trade unions are parties to collective bargaining and they should, whenever possible, negotiate suitable whistleblowing procedures with employers. Protection should be granted when an individual seeks advice from a trade union. Likewise, the right to be represented by a trade union has to be secured. Another welcomed addition would be to grant protection for unions carrying the report. Also, trade union representatives should also be designated as appropriate internal recipients of reports.

3. Protect reports to line manager and Human Resources department

It is not self-evident that the directive protects reports made to the line manager or to the human resources department. Therefore, it should be clarified on national level that protection is granted when reporting wrongdoings to the superiors or HR. This minimises the threshold for whistleblowers to report about wrongdoings.

4. Access to documents

When a whistleblower comes across sensitive information it will matter how the information was obtained – for example if it was found in stolen documents or acquired lawfully. The criminal liability clause is up to the member state to define. As a reminder, big media attention cases like LuxLeaks, would have never happened if the whistleblower would not have copied the documents “unlawfully”. Therefore, member states might want to carefully consider the formulation of this clause.

5. Definition of reasonable belief

The directive introduces the public interest test, which requires the whistleblower to have reasonable grounds to believe that something was true at the time of reporting in the public interest. The legal requirement of reasonable belief is problematic for the reporting person and the definition of this is not set out in the directive. This public interest test of reasonable belief should be clarified in national law. A common global definition is that a disinterested observer with similar knowledge, training and background could agree with the whistleblower’s concerns.[2]

6. Employers’ burden of proof

The burden of proof is mentioned in the directive, but the intention of it is watered down in the legal text of the directive. In the recitals of the directive, it is written that a whistleblower who reports about a wrongdoing and suffers a detriment, the burden of proof shifts to the person who took the detrimental action (i.e. employer) to prove that detriment was not a cause of the report. However, in the actual article in the directive the “employer” has “to prove that the measure was based on duly justified grounds”. This can leave some dangerous loopholes if not clarified in national context. A retaliation could otherwise become justified on any reasons that the employer can find.

EU Whistleblowing Meter monitors transposition process

A team of voluntary country editors are documenting national progress on transposition of the EU whistleblower directive. It is a tool to help everyone determine whether EU governments are living up to their obligations to protect whistleblowers.

The EU Whistleblowing Meter tracks the progress of transposition in each country. This is a singular opportunity for European nations to reinforce their democratic foundations and implement truly progressive, coherent, and consistent whistleblower rights across Europe that serve the interests of all.

European civil society has long understood that whistleblowing is about ensuring the right information gets to the right place so that action can be taken and proper oversight ensues.  A team of voluntary country editors are documenting national progress on transposition to help everyone determine whether EU governments are living up to their obligations to protect whistleblowers. We will know whether countries are acting in good faith; consulting widely and openly to develop and adopt comprehensive legal and institutional whistleblower protection measures that reinforce good governance, hold decision-makers to account and allow for substantive civic engagement.

This year our joint platform of trade unions and civil society organisations turns 5 years. Professor Wim Vandekerckhove from University of Greenwich has analysed the work of the platform in reaching a directive.

This year our joint platform of trade unions and civil society organisations turns 5 years. That is also when things started moving forward in the European Parliament with the Greens/EFA group publishing its first draft proposal for a directive on whistleblower protection. Thereafter, the own-initiative report by Virginie Rozière (S&D) came about, leading to a support from the Parliament on such a directive, which in the end culminated in a directive proposal from the European Commission. Today, we are expecting the directive, that was finally adopted in 2019, to be transposed into national legislation by the end of the year.

Professor Wim Vandekerckhove from University of Greenwich has analysed the work of the platform in reaching a directive in his paper Is It Freedom? The Coming About of the EU Directive on Whistleblower Protection. In his analysis, he especially puts “[…] focus on two issues [that] the campaigning platform fought for: (1) the material scope of ‘public interest’, and (2) the three-tiered approach to protected disclosure.[1]

Transposition 2021, a race against time

In 2019 the European Union adopted a ground-breaking Directive to ensure comprehensive and coherent protection of whistleblowers across Europe.  Civil society, including anti-corruption and transparency NGOs, trade unions, journalist associations, and academics were instrumental in calling for legal protections and ensuring the Directive set out a strong foundation to protect the right to speak out against wrongdoing and harm.

Whistleblowing is essential to protecting the public interest – whether it is reporting the corruption that results in sub-standard PPE equipment for front-line workers during COVID-19, or revealing systematic non-compliance with environmental or other safety standards which pollutes the air we breathe, the food we eat or the water we drink. Whistleblowers help responsible businesses learn about problems before the damage is done and help hold irresponsible organisations to account for their wrongdoing or negligence.

Twenty-seven Member States have until December 2021 to transpose the Directive into their national systems.  Progress has been slow and monitoring transposition has revealed some serious problems. For example,

  • Some countries are debating whether or not to protect those who report breaches of national as well as EU law despite the fact that a failure to do so would make a nonsense of any national system to protect whistleblowers
  • Policy makers are still discussing a ‘good faith’ test for whistleblowers despite the EU Directive making it clear that motive is irrelevant as to whether protection is available
  • Too few countries are taking the opportunity to reinforce the freedom of expression provisions to protect public disclosures and journalist sources

What should be the role of trade unions in whistleblowing? Which internal arrangements, should be in place to establish a culture which promotes whistleblowing? In a toolkit developed in a project cooperation between Protect and Eurocadres a best practice for whistleblowing is put forward.

The toolkit is an outcome of a project carried out by Eurocadres in cooperation with Protect, the UK’s whistleblowing charity with over 25 years’ experience advising workers on whistleblowing rights and promoting best practice amongst employers. Protect is also part of WhistleblowerProtection.EU, the whistleblowing directive campaign and advocacy platform created by Eurocadres. The project including the development of the toolkit is financed by the European Commission,

In a foreword to the publication Martin Jefflén, Eurocadres President writes: After several years of hard work there is now an EU Directive in place to protect whistleblowers. The Whistleblowing Directive offers both an opportunity and a responsibility for trade unions, and not only for trade unions representing professionals and managers.

Complex role of trade unions

The toolkit contains a model policy and discusses the sometimes complex role of trade unions, sometimes representing both the whistleblower and the person accused of wrongdoing. In a number of case studies the reader is invited to reflect on practical situations, which lessons can be learned from these situations, and what trade unions can do to help in these cases.

With the Whistleblowing Directive under transposition all trade unions with more than 50 employees will eventually be obliged to put in place an internal reporting channel. The toolkit is to assist trade unions in the work to engage with employers in the setup of internal reporting channels.

EU Whistleblowing Meter Launched to Monitor Transposition of EU Directive on Whistleblowing

In April 2019, the European Parliament adopted a game-changing Directive designed to protect whistleblowers across Europe. Once the Council of the European Union and the European Parliament approved the new law, it came into force on 16 December 2019. Twenty-seven countries have until the end of 2021 to transpose these far-reaching provisions into their own legal and institutional systems. This is where reality hits.  Now the true commitment of governments to protect those who speak up in the public interest in Europe will be put to the test!

Today, on World Whistleblowing Day, 23 June, the Whistleblowing International Network along with its many partners and colleagues across Europe are launching the EU Whistleblowing Meter to track the progress of transposition in each country. This is a singular opportunity for European nations to reinforce their democratic foundations and implement truly progressive, coherent, and consistent whistleblower rights across Europe that serve the interests of all.

European civil society has long understood that whistleblowing is about ensuring the right information gets to the right place so that action can be taken and proper oversight ensues.  Over the next 18 months, we will work with our team of voluntary country editors to document national progress on transposition to help everyone determine whether EU governments are living up to their obligations to protect whistleblowers.  We will know whether countries are acting in good faith; consulting widely and openly to develop and adopt comprehensive legal and institutional whistleblower protection measures that reinforce good governance, hold decision-makers to account and allow for substantive civic engagement.

Anna Myers, Executive Director of WIN explains, “Whistleblower protection is only successful when civil society is fully engaged, keeping authorities accountable for their actions. The EU Whistleblowing Meter is a simple and effective way to monitor transposition. We need governments to get this right, especially now, as the crisis of COVID-19 reinforces the critical importance of information flowing freely to help us keep ourselves and our communities safe, and to prepare for a different future.”

Whistleblowing saves lives. Individuals are speaking out across Europe and around the world about the lack of protective equipment and systems to protect the health of front-line workers in medical and social care sectors, in transport, food supplies, and critical infrastructure and they are forcing governments to respond.

“Whistleblower protection is a workplace issue”, says Martin Jefflén, President of Eurocadres, the European trade union organisation of professionals and managers, and convener of the WhistleblowerProtection.EU coalition. “The EU Directive to protect whistleblowers was a huge step for Europe and now we need to make it work on the ground. Eurocadres is delighted to join WIN in supporting our trade union and wider coalition members in monitoring and advocating for whistleblower protections that go well beyond the minimum required and to secure stronger workers’ and trade union rights. It is a matter of social and economic well-being.”

Nick Aiossa, Deputy Director and Head of Political Integrity at Transparency International EU agrees. “We have 18 months to make the vital legal protections for whistleblowers that we worked so hard to achieve at EU level, really work in practice at national level. These are the same months that Europe will be easing the COVID-19 restrictions. More whistleblowers will be letting us know where and how the existing weaknesses in our systems were corrupted to siphon essential public funds away from those who needed them the most. The EU Whistleblowing Meter will help us demand the change we need across Europe to ensure we protect the whistleblowers who help us protect the public interest.”

Coalition to make whistleblowing safe during COVID-19 and beyond

The signatories to this letter call on all public authorities and institutions to protect those who report or expose the harms, abuses and serious wrongdoing that arise during this period of crisis caused by the COVID-19 pandemic. We also encourage all citizens and workers to participate in ensuring our governments, corporate institutions and markets remain accountable, and in defending the human rights and freedoms of all people.

The COVID-19 pandemic brings into stark relief the importance of accountability and the need for regular and reliable information from our public institutions and our leaders. The people of every affected country need to know the truth about the spread of the disease both locally and internationally in order to respond effectively and help protect their communities. Fairness, transparency and cooperation are vital and never more so than during a pandemic.

We have already seen examples of wrongdoing and mismanagement in our public institutions, commercial markets and business as a result of COVID-19. Emerging areas of concern include health system capacity and delivery, public procurement, violations of health and safety and labor law, inequitable and ill-prepared global supply chains, unfair competition practices and market abuses, and significant violations of personal privacy rights at scale through the digital tracking of individuals.

Proper notification of risk to the public and to workers, fair and responsible conduct by all institutions, and transparent data collection are all critical to public confidence in our ability to overcome this crisis. This is even more important when the protections normally provided by the fundamental democratic pillars of our societies are curtailed or side-stepped. Parliaments and democratic assemblies are being suspended in many countries. The use of extraordinary powers by governments without proper public oversight and transparency creates a tangible risk of overreach and potential misuse.

When decisions are taken in emergency conditions, often away from democratic scrutiny, whistleblowers can play a vital early warning role. They are the corrective fail-safe mechanism in any society, especially in an international health crisis when the public’s right to know can have life-or-death implications. In this time of crisis and beyond, we encourage citizens and workers to participate in ensuring that proper accountability is maintained in our governments, corporate institutions and markets, and in defending the human rights and freedoms of all people.

During this pandemic we have already witnessed abuses. At various times, the fundamental rights of freedom of expression and access to information have been restricted. The cost of these actions is most severely borne by the most vulnerable members of our communities: the elderly, the poor, immigrants and refugees, LGBTQ communities, prisoners, the multitudes of precarious workers as well as frontline workers in the crisis.

Whistleblowing has proven to be a powerful tool to fight and prevent actions that undermine the public interest. Our organizations call on all public authorities and corporate institutions to protect those who expose harms, abuses and serious wrongdoing during the COVID-19 crisis, and beyond. Workers are taking risks daily to maintain the many essential services which we rely upon, especially in these times, our health services, care for elderly care and other social and public services, as well as food supply and logistics, just to name a few. The importance of these workers, their right to a safe working environment and to speak up about threats to public health and safety, corruption, and other abuses must be recognized and protected. Their disclosures, as well as those from all citizens, are vital to preventing major disasters and reducing the impacts of the crisis on us all, especially on the most vulnerable members of society and our democratic systems.

In the final session before the EU elections, the European Parliament will vote for a new EU Directive to protect whistleblowers in Europe. Civil society played an essential role in making this happen.

Press, politicians and civil society will gather to assess this landmark break-through in legal rights for citizens acting in the public interest, and how it will help to strengthen transparency and accountability in Europe.

As the scandals revealed by whistleblowers in LuxLeaks and Panama Papers investigations continue to reverberate around Europe and the world, and new information sheds light on wrongdoing affecting our financial systems, our food, and our environment, we also take a moment to highlight the work ahead.

Our work is to turn legal rights into active protection and to advance whistleblowing disclosures to achieve lasting change in the public interest.
