New civil society monitor on the EU Whistleblowing Directive

The partnership of Eurocadres, the Whistleblowing International Network (WIN) and Transparency International EU is delighted to announce the development and launch of EU Whistleblowing Monitor, a new online platform to monitor transposition and implementation of the EU Directive on Whistleblowing (2019/1937) across Europe.

Launch of the Whistleblowing Monitor

The EU Whistleblowing Monitor will continue the amazing collaborative efforts of our strong civil society coalition to track the transposition of these new protections for whistleblowers across the European Union. The 27 EU Member States only have until 17 December 2021 to get this done!

What’s it all about?

EU Directive 2019/1937 on the protection of persons who report breaches of Union law is meant to provide a coherent pan-European whistleblowing framework - requiring EU governments to meet minimum standards for establishing reporting channels, ensuring comprehensive legal protection and immunities for whistleblowers, and introducing effective penalties to dissuade retaliation.

How are EU Member States doing?

All Member States will need to engage in significant legal and institutional reform. Most will need to adopt a new law, or make comprehensive amendments – indeed, only 10 EU countries already had dedicated whistleblowing legislation.

Now, some 18 months into the 2-year deadline for transposition, several countries have finally produced draft laws and some are consulting relevant stakeholders and the public on those proposals. A recent progress report published by WIN and Transparency International found huge delays in the process. Two-thirds (18) of member states have made minimal or no progress and the levels of transparency and inclusiveness are poor or non-existent.

How does the EU Whistleblowing Monitor work?

A team of over 30 country editors who understand the importance of whistleblowing protection as a key democratic accountability mechanism are actively contributing to the project. They are monitoring developments nationally and sharing best practices. All contributors are donating their time and expertise to the Monitor, and many are involved in campaigns for stronger whistleblowing protections in their countries. They know that transposition represents a pivotal opportunity to push governments to introduce progressive provisions which go beyond the minimum standards of the Directive.

The EU Whistleblowing Monitor is a simple and effective public interface for any interested citizen to see whether their government is taking whistleblowing protection seriously.

What else is there?

The new site highlights relevant resources and tools developed by experts and practitioners to help analyse and benchmark new draft proposals and help law makers and civil society advocates understand the risks of taking a tick-box or ‘verbatim’ approach to transposition.

We are also delighted to post important initiatives like the declarations of the Network of Integrity and Whistleblowing Authorities which play an essential role in protecting whistleblowers and have a wealth of practical experience to share. You can also find the Minutes from the Expert Group set up by the European Commission to support Member States in meeting the requirements of the Directive as well as following WIN’s series of briefings on key areas of concern.

What can you do?

As of today, there are just 6 months left for transposition to be completed. As governments scramble to meet the deadline we cannot allow last minute, poor quality transposition to undermine the very spirit of the Directive – which is the proper protection of individuals who risk their careers and personal safety to speak up in the public interest. So please help us to monitor the Monitor!

Check out what your country is doing to protect whistleblowers and spread the word. The more the public actively supports whistleblowers who speak out about corruption and wrongdoing and demands their protection, the more likely we are to get it!

EU Whistleblowing Meter monitors transposition process

A team of voluntary country editors are documenting national progress on transposition of the EU whistleblower directive. It is a tool to help everyone determine whether EU governments are living up to their obligations to protect whistleblowers.

The EU Whistleblowing Meter tracks the progress of transposition in each country. This is a singular opportunity for European nations to reinforce their democratic foundations and implement truly progressive, coherent, and consistent whistleblower rights across Europe that serve the interests of all.

European civil society has long understood that whistleblowing is about ensuring the right information gets to the right place so that action can be taken and proper oversight ensues. A team of voluntary country editors are documenting national progress on transposition to help everyone determine whether EU governments are living up to their obligations to protect whistleblowers. We will know whether countries are acting in good faith; consulting widely and openly to develop and adopt comprehensive legal and institutional whistleblower protection measures that reinforce good governance, hold decision-makers to account and allow for substantive civic engagement.

The Whistleblowing International Network (WIN) is an international charity based in Scotland. This year our joint platform of trade unions and civil society organisations turns 5 years. Professor Wim Vandekerckhove from University of Greenwich has analysed the work of the platform in reaching a directive.

This year our joint platform of trade unions and civil society organisations turns 5 years. That is also when things started moving forward in the European Parliament with the Greens/EFA group publishing its first draft proposal for a directive on whistleblower protection. Thereafter, the own-initiative report by Virginie Rozière (S&D) came about, leading to a support from the Parliament on such a directive, which in the end culminated in a directive proposal from the European Commission. Today, we are expecting the directive, that was finally adopted in 2019, to be transposed into national legislation by the end of the year.

Professor Wim Vandekerckhove from University of Greenwich has analysed the work of the platform in reaching a directive in his paper Is It Freedom? The Coming About of the EU Directive on Whistleblower Protection. In his analysis, he especially puts “[…] focus on two issues [that] the campaigning platform fought for: (1) the material scope of ‘public interest’, and (2) the three-tiered approach to protected disclosure.[1]

Transposition 2021, a race against time

In 2019 the European Union adopted a ground-breaking Directive to ensure comprehensive and coherent protection of whistleblowers across Europe. Civil society, including anti-corruption and transparency NGOs, trade unions, journalist associations, and academics were instrumental in calling for legal protections and ensuring the Directive set out a strong foundation to protect the right to speak out against wrongdoing and harm.

Whistleblowing is essential to protecting the public interest – whether it is reporting the corruption that results in sub-standard PPE equipment for front-line workers during COVID-19, or revealing systematic non-compliance with environmental or other safety standards which pollutes the air we breathe, the food we eat or the water we drink. Whistleblowers help responsible businesses learn about problems before the damage is done and help hold irresponsible organisations to account for their wrongdoing or negligence.

Twenty-seven Member States have until December 2021 to transpose the Directive into their national systems. Progress has been slow and monitoring transposition has revealed some serious problems. For example,

Some countries are debating whether or not to protect those who report breaches of national as well as EU law despite the fact that a failure to do so would make a nonsense of any national system to protect whistleblowers
Policy makers are still discussing a ‘good faith’ test for whistleblowers despite the EU Directive making it clear that motive is irrelevant as to whether protection is available
Too few countries are taking the opportunity to reinforce the freedom of expression provisions to protect public disclosures and journalist sources

Best practice guide on whistleblowing for trade unions

What should be the role of trade unions in whistleblowing? Which internal arrangements, should be in place to establish a culture which promotes whistleblowing? In a toolkit developed in a project cooperation between Protect and Eurocadres a best practice for whistleblowing is put forward.

The toolkit is an outcome of a project carried out by Eurocadres in cooperation with Protect, the UK’s whistleblowing charity with over 25 years’ experience advising workers on whistleblowing rights and promoting best practice amongst employers. Protect is also part of WhistleblowerProtection.EU, the whistleblowing directive campaign and advocacy platform created by Eurocadres. The project including the development of the toolkit is financed by the European Commission,

In a foreword to the publication Martin Jefflén, Eurocadres President writes: After several years of hard work there is now an EU Directive in place to protect whistleblowers. The Whistleblowing Directive offers both an opportunity and a responsibility for trade unions, and not only for trade unions representing professionals and managers.

Complex role of trade unions

The toolkit contains a model policy and discusses the sometimes complex role of trade unions, sometimes representing both the whistleblower and the person accused of wrongdoing. In a number of case studies the reader is invited to reflect on practical situations, which lessons can be learned from these situations, and what trade unions can do to help in these cases.

With the Whistleblowing Directive under transposition all trade unions with more than 50 employees will eventually be obliged to put in place an internal reporting channel. The toolkit is to assist trade unions in the work to engage with employers in the setup of internal reporting channels.

In April 2019, the European Parliament adopted a game-changing Directive designed to protect whistleblowers across Europe. Once the Council of the European Union and the European Parliament approved the new law, it came into force on 16 December 2019. Whistleblowing saves lives. Individuals are speaking out across Europe and around the world about the lack of protective equipment and systems to protect the health of front-line workers in medical and social care sectors, in transport, food supplies, and critical infrastructure and they are forcing governments to respond.

“Whistleblower protection is a workplace issue”, says Martin Jefflén, President of Eurocadres, the European trade union organisation of professionals and managers, and convener of the WhistleblowerProtection.EU coalition. “The EU Directive to protect whistleblowers was a huge step for Europe and now we need to make it work on the ground. Coalition to make whistleblowing safe during COVID-19 and beyond

The signatories to this letter call on all public authorities and institutions to protect those who report or expose the harms, abuses and serious wrongdoing that arise during this period of crisis caused by the COVID-19 pandemic. We also encourage all citizens and workers to participate in ensuring our governments, corporate institutions and markets remain accountable, and in defending the human rights and freedoms of all people.

The COVID-19 pandemic brings into stark relief the importance of accountability and the need for regular and reliable information from our public institutions and our leaders. The people of every affected country need to know the truth about the spread of the disease both locally and internationally in order to respond effectively and help protect their communities. Fairness, transparency and cooperation are vital and never more so than during a pandemic.

We have already seen examples of wrongdoing and mismanagement in our public institutions, commercial markets and business as a result of COVID-19. Emerging areas of concern include health system capacity and delivery, public procurement, violations of health and safety and labor law, inequitable and ill-prepared global supply chains, unfair competition practices and market abuses, and significant violations of personal privacy rights at scale through the digital tracking of individuals.

Proper notification of risk to the public and to workers, fair and responsible conduct by all institutions, and transparent data collection are all critical to public confidence in our ability to overcome this crisis. This is even more important when the protections normally provided by the fundamental democratic pillars of our societies are curtailed or side-stepped. Parliaments and democratic assemblies are being suspended in many countries. The use of extraordinary powers by governments without proper public oversight and transparency creates a tangible risk of overreach and potential misuse.

When decisions are taken in emergency conditions, often away from democratic scrutiny, whistleblowers can play a vital early warning role. They are the corrective fail-safe mechanism in any society, especially in an international health crisis when the public’s right to know can have life-or-death implications. In this time of crisis and beyond, we encourage citizens and workers to participate in ensuring that proper accountability is maintained in our governments, corporate institutions and markets, and in defending the human rights and freedoms of all people.

During this pandemic we have already witnessed abuses. At various times, the fundamental rights of freedom of expression and access to information have been restricted. The cost of these actions is most severely borne by the most vulnerable members of our communities: the elderly, the poor, immigrants and refugees, LGBTQ communities, prisoners, the multitudes of precarious workers as well as frontline workers in the crisis.

Whistleblowing has proven to be a powerful tool to fight and prevent actions that undermine the public interest. Our organizations call on all public authorities and corporate institutions to protect those who expose harms, abuses and serious wrongdoing during the COVID-19 crisis, and beyond. Workers are taking risks daily to maintain the many essential services which we rely upon, especially in these times, our health services, care for elderly care and other social and public services, as well as food supply and logistics, just to name a few. The importance of these workers, their right to a safe working environment and to speak up about threats to public health and safety, corruption, and other abuses must be recognized and protected. Their disclosures, as well as those from all citizens, are vital to preventing major disasters and reducing the impacts of the crisis on us all, especially on the most vulnerable members of society and our democratic systems.

What now for the new Whistleblower Protection Directve?

On Tuesday it was all about the euphoria of the whistleblower protection Directive being adopted by the European Parliament (EP) in Strasbourg. Now the hard work begins again, as politicians, trade unions, NGOs and whistleblowers meet to discuss; “The future of the new [whistleblower protection] Directive”.

EP votes for the whistleblower protection Directive by a large majority

The historic moment, when the EP voted for the whistleblower protection Directive by a large majority, has rightfully been heralded as, ‘one of the greatest successes of this European Parliament’s mandate’. But it is what happens now, in terms of individual Member State transposition of the Directive, which will determine the effectiveness of this legislation.

A few procedural steps remain before the legislation comes into force, tentatively early autumn. The EP has established that whistleblowers the from all EU member states will now be legally protected when they speak out against corruption and wrong doing in general. But it is how those countries adopt and interpret the legislation, which will provide the key. The civil society event not only celebrated the adoption of the new Directive, it also sought to chart a course for its future at Member State level.

The future of the new Directive?

Opening the civil society event, Virginie Rozière, the EP’s Rapporteur on Europe’s whistleblower protection, noted that the passing of the Directive, by such a large majority of MEPs, reflected the work done collectively by civil society, journalists as well as politicians, ‘who provided a strong foundation for what has been achieved’.

Pascal Durand MEP told attendees that civil society played a crucial role in persuading reluctant Member States of the need for a European dimension to whistleblower protection. It is hoped that these networks will remain active in terms of ensuring that Member State transposition is as effective as possible.

Deltour expressed concern that Member States may be reluctant to go beyond the material scope, covering EU competencies.

Antoine Deltour, the LuxLeaks whistleblower, speaking at the event, said suspicion of whistleblowers has diminished in recent years, as the general public now have a better understanding that whistleblowing is in the public interest, which he said helped civil society mobilise in support of the EU Directive. However, Deltour expressed concern that Member States may be reluctant to go beyond the material scope, covering EU competencies, when it comes to implementing the Directive. He feels that the legal status of whistleblowers who gather and distribute ‘secret information’ needs to be clarified in transposition, as they remain vulnerable in many European countries.

Now the hard work begins

Transparency International EU’s Senior Policy Officer Nick Aiossa continued on the theme of transposition. He said that for his organisation the hard work was just beginning, in that the minimum standards set out in the Directive, should be raised in transposition process. According to Aiossa, Member States should incorporate higher whistleblower protection standards into national legislation. He also talked of the need to increase protection for whistleblowers working in EU institutions.

Martin Jefflén President of Eurocadres stated that ‘transposition needs to fill in the gaps’, still present in the Directive, with the limitations of material scope being one of the problematic areas. Jefflén also said that trade unions will continue to fight for the rights of whistleblowers around the protection of workers, in terms of health and safety standards, for example. According to the Eurocadres President there is room for whistleblower protection to improve in the 10 countries, which already have national whistleblowers protection legislation and this will be part of the ongoing battle in the upcoming transposition process.

The national transposition of the Directive

The Executive Director of Whistleblowing International Network (WIN), Anna Myers talked of being energised by the EP’s vote approving the whistleblower protection Directive, but she also noted that ‘a lot of hard work still needs to be done at the Member State level, as a number of EU governments are showing a reluctance to fully implement the new Directive. While other Member States are indicating that they will deliberately look to minimise the level of protection, their citizens have.

WIN will be working with its members, associates and coalition partners to ensure the national transposition of the Directive, which must be completed by 2021, results in even stronger and more progressive laws to protect whistleblowers.

She hopes the transposition process will strengthen the notion, that when whistleblowers come forward that they will know that they are fully legally protected, that they will be listened to, that action will be taken and that civil society, journalists and politicians will stand by them, when the information they reveal exposes corruption and wrong doing.

So as the celebrations surrounding the European Parliament’s approval of the whistleblower protection Directive subside, it is clear that the whistleblower protection platform will be needed more than ever, as the battles over Member State transposition begins.

In the final session before the EU elections, the European Parliament will vote for a new EU Directive to protect whistleblowers in Europe. Civil society played an essential role in making this happen.

Press, politicians and civil society will gather to assess this landmark break-through in legal rights for citizens acting in the public interest, and how it will help to strengthen transparency and accountability in Europe.

As the scandals revealed by whistleblowers in LuxLeaks and Panama Papers investigations continue to reverberate around Europe and the world, and new information sheds light on wrongdoing affecting our financial systems, our food, and our environment, we also take a moment to highlight the work ahead.

Our work is to turn legal rights into active protection and to advance whistleblowing disclosures to achieve lasting change in the public interest.
